Terms of Use
Version 2026-10-17 · Last updated: October 22, 2026
These terms are an agreement between you and WhereWe LLC, a Wyoming limited liability company (“WhereWe,” “we,” “us”). They cover the WhereWe app, the website at wherewe.net, and everything else we offer (together, “WhereWe”). Our Community Guidelines, including their terms for public maps, are part of these terms. Our Privacy Policy explains how we handle your information. If you sell maps, our Creator Terms apply as well.
1. Agreeing to these terms
- You agree to these terms when you create a WhereWe account or use WhereWe. If you don’t agree, don’t use it.
- When you choose your username, the app asks you to agree to these terms and the Community Guidelines, and we record which version you agreed to. You can’t publish a map without that agreement.
- If you only look at public pages on wherewe.net without an account, the parts of these terms about using the website, places, third parties, disclaimers, liability, and disputes apply to you.
- If you use WhereWe for an organization, you agree for it too, and you confirm you’re allowed to.
2. Who can use WhereWe
- You must be at least 13, or older if the law where you live requires an older age to use a service like WhereWe without a parent’s consent (for example, up to 16 in some European countries).
- If you’re under 18, or under the age of adulthood where you live, a parent or guardian must agree to these terms for you, and should help you with purchases.
- To sell maps you must be at least 18, or the age of adulthood where you live if that’s older (see the Creator Terms).
- You can’t use WhereWe if we’ve banned you before, or if the law forbids you from using it (for example, sanctions laws).
3. Your account
- Keep your sign-in safe. You’re responsible for what happens on your account; tell us at support@wherewe.net straight away if you think someone else is using it.
- The information you give us must be accurate. An account is for one person.
- Your username and display name are public. They must follow the Community Guidelines: they can’t impersonate anyone, pose as WhereWe or its staff, or use someone else’s trademark in a misleading way. We may stop a name from being shown, or reclaim a username that breaks these rules or that a trademark owner has a right to.
- You can delete your account at any time from Settings in the app. The Privacy Policy explains what that deletes and what we keep.
4. Your content
- You keep ownership of what you add to WhereWe: your places, notes, ratings, maps, photos, and profile (“your content”).
- You give us the rights to run WhereWe. You give WhereWe a worldwide, non-exclusive, royalty-free license to host, store, copy, process, back up, and display your content, and to adapt it so it works in WhereWe (for example, resizing photos), in order to provide WhereWe to you and to the people you share it with, to check public content, and to keep WhereWe safe. This license ends when you delete your content or your account, except for the copies described below.
- Shared maps. Everyone on a map can see and change it. Places and photos you add to a shared map are part of it: they stay with the map for its other members if you leave it or delete your account.
- Public maps. When you publish a map, the terms for public maps apply to it: anyone with the link can see what you chose to include, people can save copies of its places, and those copies stay theirs even after you unpublish it.
- You’re responsible for your content. You confirm that you have the right to everything you add, including photos and anything other people on a shared map added before you publish it, and that it doesn’t break the law or anyone else’s rights.
- We may remove content that breaks these terms or the Community Guidelines, or that we must remove by law, and we may keep a record of it as the Privacy Policy describes. We don’t look at private maps unless someone reports something, the law requires it, or we need to in order to fix a problem you asked us to help with.
- Ideas. If you send us feedback or ideas, we may use them without owing you anything.
5. What you may not do
Follow the Community Guidelines in everything other people can see. In addition, don’t:
- break the law, or use WhereWe to help anyone else break it;
- copy, scrape, or collect content or people’s information from WhereWe by automated means, or make your own copies of maps you bought to give or sell to others;
- get around our limits — import allowances, publishing limits, reports, referrals, or free offers — for example with extra accounts, faked verifications, or devices made to look new;
- buy maps only to save their places and then ask for refunds, again and again;
- open a new account after we’ve suspended or banned you;
- interfere with WhereWe or its security, test its weaknesses, or reverse engineer it, except where the law allows you to (if you’ve found a security problem, tell us at support@wherewe.net);
- send spam, make false reports, or harass people through WhereWe;
- use WhereWe’s name, logo, or look in a way that suggests we endorse you, without our written permission.
6. Purchases, subscriptions, and refunds
Everything is sold through Apple
- WhereWe Pro and paid maps are sold through Apple’s in-app purchase. Apple takes the payment, charges any sales tax or VAT, and shows you the price in your currency before you buy. Apple’s Media Services Terms apply to the payment. We never see your card details.
- Prices can change. A change never affects a purchase you’ve already made; Apple tells you before a subscription renews at a higher price, as its rules require.
WhereWe Pro
- Pro is a subscription. It renews automatically at the end of each period, at the price shown when you subscribed, unless you turn off auto-renew at least 24 hours before the period ends. Apple charges your Apple Account when you confirm the purchase and again within 24 hours before each renewal.
- Manage or cancel it in your iPhone’s Settings › your name › Subscriptions (or in the App Store). Cancelling stops the next renewal; Pro keeps working until the end of the period you’ve paid for. Deleting the app or your WhereWe account doesn’t cancel a subscription: Apple does that.
- If we offer a free trial, any unused part of it ends when you buy a subscription.
- Pro includes fair-use limits on AI imports, explained in the app. Free imports, referral bonuses, and other free allowances have no cash value, can’t be transferred, and may change.
Paid maps
- Buying a map is a one-time purchase. It lets you open the whole map in WhereWe for as long as its creator keeps it published. The places you save from it into your own maps are yours to keep.
- If the creator unpublishes the map, you can’t open it until they publish it again. If the creator deletes their account, or we remove the map because it broke our rules, it’s gone for good. In those cases you can ask Apple for a refund.
- Maps are sold by their creators; WhereWe sells them on the creators’ behalf and reviews them before they go on sale, but doesn’t write them. A paid map is the creator’s recommendations, not a guarantee (see section 8).
- A purchase made in a test version of the app (TestFlight) unlocks a map for 7 days only.
Refunds
- All refunds are handled by Apple, under Apple’s policies. We can’t issue refunds ourselves. To ask for one, go to reportaproblem.apple.com.
- If Apple refunds Pro, Pro ends. If Apple refunds a paid map, the map locks again, and the sale is taken out of its creator’s earnings, as the Creator Terms explain.
- Where the law gives you a right to cancel or a refund that can’t be excluded, nothing in these terms takes it away.
7. AI features
- Import. When you import an Instagram or TikTok post, AI (Anthropic’s Claude) reads the post’s public caption and image and suggests the places it mentions, and Google Places helps find them; Apple Maps places them on your map. The AI can be wrong: it can miss a place, name the wrong one, put it in the wrong city, or write a description that isn’t accurate. Check every suggestion before you save it. Nothing is added until you do.
- Checks of public maps. AI checks public maps for content that breaks our rules, and a person looks at anything it flags. These checks can make mistakes in both directions. If you think we got a decision wrong, email us (see the Community Guidelines).
- Only import posts you’re allowed to look at, and don’t publish AI-written text as if it were a fact you checked.
8. Places and the real world
- Places, notes, ratings, and maps on WhereWe come from the people who use it. They’re opinions. We don’t check that a place exists, is open, is safe, is accessible, or is described correctly, and we don’t endorse any place or business.
- Before you go somewhere, check it yourself: opening hours, safety, local laws, and whether you’re allowed in. Respect private property. You visit places at your own risk.
- Map positions can be wrong. Don’t rely on WhereWe for navigation where a mistake could be dangerous.
9. Other companies’ services
WhereWe relies on services from other companies, and some features take you to them. Their own terms and privacy policies apply to how you use them, and we’re not responsible for them:
- Apple — the App Store and in-app purchases, Sign in with Apple, Apple Maps (the maps in the app, and “Open in Apple Maps”), and notifications.
- Google — Firebase (sign-in, database, storage, the server, notifications, crash reports, and usage statistics), Sign in with Google, Google Places (to find places during an import), and Google Maps (“Open in Google Maps”).
- Anthropic — the Claude AI that reads imported posts and checks public maps.
- OpenStreetMap, OpenMapTiles, and OpenFreeMap — the maps on public map pages on wherewe.net (see Credits).
- Instagram, TikTok, and Apify — the posts you choose to import. WhereWe isn’t affiliated with, endorsed by, or sponsored by Instagram or TikTok.
- PayPal — payouts to creators who sell maps.
Links on WhereWe, including links people add to their places, can lead to websites we don’t control.
10. WhereWe’s rights, and copyright
- WhereWe — the app, the website, the name, the logo, and the design — belongs to us and is protected by law. We give you a personal, limited, non-exclusive, non-transferable right to use the app and the website as these terms allow. You don’t get any other rights to them.
- If you believe something on WhereWe infringes your copyright, follow our Copyright Policy. We remove infringing content when we’re notified properly, and we close the accounts of people who infringe again and again.
- The fonts, map data, and open-source software WhereWe uses are listed, with their licenses, on our Credits page.
If you got the app from the App Store
- These terms are between you and WhereWe, not Apple. Apple isn’t responsible for the app or its content, and has no obligation to provide maintenance or support for it.
- Apple’s standard Licensed Application End User License Agreement applies to your use of the app, together with these terms.
- If the app fails to meet a warranty that the law gives you, you may tell Apple, and Apple will refund the app’s purchase price, if any; Apple has no other warranty obligation for the app. Apple isn’t responsible for claims by you or anyone else about the app (for example, product liability, legal or regulatory compliance, consumer protection, or intellectual property claims); we are, to the extent these terms say.
- You confirm you’re not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Suspension, closing accounts, and changes to WhereWe
- You can stop using WhereWe at any time, and delete your account from Settings in the app.
- If you break these terms or the Community Guidelines, we may hide your content, stop your maps from being listed or sold, suspend your account, or ban it, as the Community Guidelines describe. We may also suspend or close an account if the law requires it, or to protect people or WhereWe. In serious cases we may act straight away and without warning. Where we can, we tell you why in the app.
- A banned account is switched off and can’t sign in, and its public maps and profile come down. Maps you bought can’t be opened from a banned account. Refunds are up to Apple. What a creator is owed is covered by the Creator Terms.
- We may change, add, or remove features, and we may stop offering WhereWe altogether. If we stop WhereWe, we’ll tell you at least 30 days before, where we can, so you have time to keep what matters to you. During that time you can ask us at support@wherewe.net for a copy of your places, and we’ll send it to you.
- Sections 4 (for content that stays), 6 (refunds), 8, 10, and 12 to 15 keep applying after your account is closed.
12. Disclaimers
WhereWe is provided “as is” and “as available.” As far as the law allows, we make no promises or warranties about it beyond those in these terms, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we don’t promise that WhereWe will always be available or free of errors, that the places, maps, or AI suggestions in it are accurate, or that your content will never be lost: keep your own copies of photos that matter to you. Some places don’t allow these exclusions, so some of them may not apply to you.
13. Limitation of liability
As far as the law allows:
- WhereWe and its members, managers, employees, and agents aren’t liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from WhereWe or these terms, even if we were told they were possible.
- We aren’t liable for what other people post or do, for places and businesses you find through WhereWe, or for other companies’ services.
- Our total liability for all claims about WhereWe or these terms is limited to the greater of what you paid for WhereWe (through Apple) in the 12 months before the claim arose, and US$50.
Nothing in these terms limits liability that the law doesn’t allow to be limited, such as liability for fraud, for death or personal injury caused by negligence, or your rights as a consumer where you live.
14. Indemnity
As far as the law allows, you agree to defend and compensate WhereWe and its members, managers, employees, and agents for claims, losses, and reasonable costs (including legal fees) that come from your content, from your breaking these terms or the law, or from your infringing someone else’s rights. We’ll tell you about such a claim and may choose to handle it ourselves.
15. Governing law and disputes
- Talk to us first. If you have a problem with WhereWe, email support@wherewe.net and give us 60 days to try to sort it out before you start a formal dispute. We’ll do the same.
- Governing law. These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. If you’re a consumer living in a country whose laws give you protections that can’t be waived, you keep those protections.
- Where disputes are decided. Any dispute that can’t be settled informally will be decided by the courts located in Sheridan County, Wyoming, and you and we agree to their jurisdiction. Either of us may instead bring a claim in a small-claims court where it qualifies. If you’re a consumer in the EU or the UK, you may also bring a claim in the courts where you live.
- If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a part straight away, we can still enforce it later. You can’t transfer your rights under these terms; we may transfer ours, for example to a company that takes over WhereWe. These terms, with the documents they link to, are the whole agreement between you and us about WhereWe.
16. Changes to these terms
We may update these terms as WhereWe changes. We’ll post the new version here with a new date. If a change matters to you, we’ll tell you in the app or by email before it takes effect, and where the change is significant or the law requires it, we’ll ask you to agree to it in the app. If you keep using WhereWe after a change takes effect, you accept it; if you don’t agree, stop using WhereWe and delete your account.
